India Orders Caller ID Apps to Share Spam Reports With Telcos

A March draft invoked India’s IT laws, but the final announcement did not confirm that route. Kazim Rizvi of The Dialogue says rules must distinguish individual reports from datasets, reputation signals and analytics, while clarifying notice, consent, retention and use. TRAI did not clarify scope or coverage of Android and iOS spam tools.
Automatically initiated calls, including robocalls and prerecorded or artificial voices, now fall under TRAI’s application to person, or A2P, framework. Companies must predeclare systems and numbers to telcos, with undeclared A2P calls treated as spam. Srivastava says initiation, not merely an AI voice, is the test, leaving human initiated AI calls uncertain. Former TRAI additional secretary Satya N. Gupta says AI remains permitted with disclosure. Telcos may charge up to 5 paise, about 0.052 cents, per A2P minute, with designated ranges exempt. Rizvi warns software enabled human calls from contact centers and click to call services could also qualify.
