Summary

Brian Richard Fitzgerald, 51, a New Jersey deputy attorney general, was arrested at his home Thursday on felony charges related to AI-generated child sexual abuse material. Bucks County Detectives allege he transformed social-media photos of real minors into sexualized images and distributed them online. He is charged with possessing CSAM, disseminating CSAM photos or film, and criminal use of a communication facility.

The National Center for Missing and Exploited Children received a July tip about an illicit image shared by a Discord user. Digital forensics, subscriber records and associated IP addresses led investigators to Fitzgerald’s home. A Thursday search recovered prompts and scripts used with an unnamed AI program, plus chats in which “thegentlemanpervert_2160_07833” allegedly admitted creating and sharing multiple illicit images. Fitzgerald’s LinkedIn says he has served as deputy attorney general since 2016, prosecuting insurance fraud and insurance licensee cases.

The Justice Department established in 2024 that AI-generated CSAM remains CSAM after charging a Wisconsin man with distributing thousands of realistic images of prepubescent minors through Telegram and Instagram. Earlier in 2026, a Pennsylvania police officer was arrested for allegedly making AI pornography from driver’s-license photos, while a Korean officer later faced allegations involving AI pornography and CSAM. New Jersey district attorney Joe Khan said AI CSAM is equally harmful and pledged aggressive prosecution regardless of profession or title.

Positives

  • A July tip to the National Center for Missing and Exploited Children initiated the investigation.
  • Digital forensics, subscriber records and IP addresses traced the Discord account to Fitzgerald’s home.
  • Thursday’s search recovered AI prompts, scripts and Discord chats that detectives say document the alleged conduct.
  • The Justice Department’s 2024 position gives law enforcement clear grounds to prosecute AI-generated CSAM as CSAM.
  • Joe Khan pledged aggressive enforcement regardless of an accused person’s profession or title.

Risks & concerns

  • Photos of real minors were allegedly converted into sexualized images and distributed through social media.
  • Brian Richard Fitzgerald held a senior prosecutorial role in New Jersey’s top legal and law enforcement office.
  • The alleged Discord chats describe multiple illicit images, suggesting conduct beyond the image identified in July.
  • Related arrests involving police officers in Pennsylvania and Korea show that public officials can misuse AI image tools.
  • The AI program allegedly used to create the material has not been identified.
